Bristol, PA October 13, 2009 – Mr. Louie Chong, a representative of AMI Entertainment Network Inc., and his colleagues recently visited the Panyu District Public Security Bureau, Panyu District People’s Procuratorate and Panyu District People’s Court in Guangzhou City, China. Mr. Chong wished to demonstrate appreciation and thanks to the authorities for their professional and efficient performance in the investigation, prosecution, and trial of Yan Xiancheng for counterfeiting the Megatouch trademark.
Defendant Yan Xiancheng committed the criminal offence of counterfeiting internationally recognized game console brands under the unregistered company Chengtai Electronic Technology Limited Company. In August 2006, the Guangzhou Administration of Industry and Commerce seized fake Megatouch machines at Yan Xiancheng’s premises and imposed an administrative penalty on him in March 2007. The defendant showed no remorse and flagrantly continued to violate the law by continuing his infringement activities. In March 2008, the Panyu District Public Security Bureau accepted a complaint from the trademark owner’s agent and promptly seized a large quantity of illegally assembled game machines bearing three internationally known brands. Following an appraisal by the local pricing certification authority, the value of the seized goods was determined to be approximately RMB1 million.
The authorities mentioned above put much arduous and careful work into their criminal investigation, prosecution and trial of the case. The Panyu District People’s Court eventually sentenced Yan Xiancheng to 3½ years imprisonment and a fine of RMB30,000. The Guangzhou Intermediate People’s Court dismissed the defendant’s appeal against the judgement.
During his visit, Mr. Chong, expressed his respect to relevant leaders and officers in charge of the case from the Panyu District Public Security Bureau, the Panyu District People’s Procuratorate and the Panyu District People’s Court.
Mr. Chong expressed the belief that the successful trial of Yan Xiancheng case is convincing evidence of China government’s strategy of maintaining an excellent investment environment, protecting intellectual property rights, and pro-actively promoting the development of intellectual property rights. AMI Entertainment Network has full confidence in its business development in China and Guangdong. The relevant leaders and officers in charge of the case mentioned above also stated that legal protection of intellectual property rights is their duty. They pledged to continue to work hard to combat serious infringement activities such as passing off and counterfeiting, so that the lawful interest of right-holders and the consumers can be protected, fair market competition can be maintained, and the healthy development of the local economy can be promoted.
At the conclusion of the visit, AMI Entertainment Network presented a plaque, engraved with the phrase “Combat Crimes as Fast as Thunderbolt” to the Panyu District Public Security Bureau, as a token of appreciation. The Panyu District People’s Procuratorate was presented with a plaque bearing the inscription “Fair Handling of Cases Merits People’s Respect; Faithful Practising of Harmony Deserves Enterprises’ Praise.” Finally,the Panyu District People’s Court was presented with a plaque praising it for “Handling Cases According to Law and Discharging Duties in a Strict Way.”
